

General Terms and Conditions
General Terms of Use and Conditions for ordering books from PDF files from the Buchbinderei Burkhardt AG, 8617 Mönchaltorf, hereinafter referred to as the «Bookfactory». As at: 01.11.2009.
1. Object of the agreement
The customer shall place an order with the Bookfactory to produce one or several books from PDF files he or she delivers. The contractual partner of the customer is the Buchbinderei Burkhardt AG. The order is solely valid in connection with the current guidelines for creating PDF files for producing books at the Buchbinderei Burkhardt AG and the current prices. These can be obtained from our homepage at www.pdf-to-book.ch.
2. Right of cancellation
The right of return or cancellation is excluded as the books created are produced according to the specifications of the customer and are tailored to his/her personal requirements.
3. Liability
The Bookfactory shall not be liable for any damage or loss of any data or pictorial material, delays in delivery, or in any other cases of damage, only in the case of wilful and gross negligent actions, and for the existence of warranted characteristics.
4. Copyright
The customer is solely responsible for the contents of photos and texts sent. The customer shall assure that he or she has all the required copyright, trademark, or other necessary rights. All consequences arising from any possible infringement of these rights shall be borne solely by the customer and he shall indemnify the Bookfactory of any third party claims arising. The customer shall when placing the order assure that the contents of the photos and texts sent do not violate criminal law, in particular the regulations with regard to the distribution of child pornography. The customer may not use any digital photos whose content within the framework of the PDF print service, or whose circulation may in any way be offensive, menacing, libellous, malicious or defamatory, or which promote hatred, suicide or the glorification of violence, or which may otherwise violate personal rights, or the personal image or view of a person.
5. Reservation of proprietary rights
The goods shall remain the property of the Buchbinderei Burkhardt AG until complete payment has been effected.
6. Warranty for defects
A book from PDF files is defective if it does not correspond to the technical standard of the manufacturing procedure used. The Bookfactory does not provide any guarantee for 100% colour fastness in the printing process. The customer shall assert any claim for defects in writing within two weeks after receipt. Defects which arise from improper use, such as pages which have been torn out, cannot be accepted.
7. Court of jurisdiction
Swiss Law shall exclusively apply in the case of these Terms of Use and Conditions, and for the installation and use of PDF software. The law courts in Zurich (Switzerland) are exclusively stipulated as court of jurisdiction for all disputes arising from, or in connection with, these Terms of Use and Conditions, or in connection with the use of the PDF print service, or with the installation or use of the software.
